THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.28911 of 2016 ORDER :

Petitioner's grievance is that in spite of a specific order passed by this Court on 25-06-2014 in W.P.No.2968 of 2014 and batch directing conduct of elections among the Mussalies for constituting a Managing Committee for Modampalli Mosque, the 2nd respondent has not prepared any voters list and is proceeding to conduct elections under the direction of a Hon'ble Minister in the Government of Andhra Pradesh.

Sri Arifulla, learned Standing Counsel for 2nd respondent refuted the above allegations and contended that the Hon'ble Minister has just forwarded the representation of the former M.L.A. to respondent Nos.2 and 3. He also states that the 3rd respondent is in the process of preparing voters list of the Mussalies for the purpose of conducting elections and that only after such voters list is prepared, further action would be taken as per Regulation 5(ii) of the Andhra Pradesh Wakf Managing Committee (Constitution, Functions and Duties) Regulations, 2009.

In view of the said submission, the Writ Petition is disposed of directing the 3rd respondent to complete the process of preparing voters list of the Mussalies within one month from the date of receipt of a copy of this order and to thereafter conduct election as per Regulation 5(ii) referred to above. No costs.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
