HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44325 of 2016 ORDER:
The present writ petition is filed by the petitioner, seeking to declare the action of the respondents in not following Rule 7 (2) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Rules, 1995 (for short 'the Rules') in FIR No.327 of 2016 of Khammam IITown Police Station, Khammam, as illegal and arbitrary. Heard and perused the material available on record. The main grievance of the petitioner is that basing on the complaint, dated 18.08.2016, lodged by him before the 4th respondent, Crime No.327 of 2016 was registered. But the police did not choose to conduct investigation by following Rule 7 (2) of the Rules.
Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order: The respondents 2 to 4 are directed to conduct investigation in Crime No.327 of 2016 on the file of the II-Town Police Station, Khammam, by following Rule 7 (2) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Rules, 1995, complete the same and file a final report, as expeditiously as possible. With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
