HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.40364 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking issuance of a Writ of Mandamus directing respondents 2 and 3 to decide the appeal No.F2/10618 of 2013 filed by the petitioner against the order dated 18.06.2013 passed by the Revenue Divisional Officer, Miryalguda, in Tenancy Case No.G3/2583/2010, at the earliest. Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondent Nos.1 to 3. With their consent, the writ petition is disposed of at the stage of admission itself. There is no necessity to put respondent No.4 on notice since this Court is not venturing to adjudicate the case on merits.

Learned counsel for the petitioner submits that initially the appeal was preferred before the District Collector, Nalgonda, but in view of formation of new Districts, the appeal now has to be heard by the District Collector, Suryapet.

Learned AGP would submit that since the appeal is filed in the year 2013, a suitable direction may be given to the 3rd respondent to dispose of the appeal, in accordance with law, at the earliest.

Having considered the rival submissions made, the writ petition is disposed of directing the 2nd respondent-The District

Collector, Nalgonda, to transfer the entire file relating to appeal No.F2/10618 of 2013 filed by the petitioner to the 3rd respondentThe District Collector, Suryapet, in which event, the appeal shall be disposed of by the 3rd respondent after hearing the petitioner and other aggrieved persons, if any including the 4th respondent, in accordance with law. This entire exercise shall be concluded within a period of three months from today.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
