The relief sought for in the Writ Petition is as follows: "to issue a writ or order or direction more particularly one in the nature of writ of mandamus declaring the action of the Respondents in conducting survey by encroaching the lands of the petitioner or dispossessing the petitioner from the lands to an extent of Ac.3-47 cents in R.S.No.104, to the extent of Ac.0-65 1⁄2 cents in R.S.No.105/2E , to the extent of Ac.0-25 cents in R.S.No.94/2, to the extent of Ac.2-00 cents in R.S.No.104, to the extent of Ac.1-21 cents in R.S.No.105/1C, to the extent of Ac.0-78 cents in R.S.No.105/1-A and to the extent of Ac.0-69 cents in R.S.No.
105/2D of Mandapadu Village, Gudivada Mandal, Krishna District, as illegal, arbitrary and in violation of principles of natural justice and against 300-A of Constitution of India and consequently direct the respondents not to interfere with the possession and enjoyment of the above said lands and consequently direct the Respondents not issue any Pattadar Pass Book and Title Deed in favour of Respondent No.7, till disposal of A.T.C.No.10 of 2012 on the file of the Special Officer Under A.P.(A.A.) Tenancy Act, 1956 Cum Junior Civil Judge At Gudivada." It is stated that in respect of the same cause of action, the petitioner filed A.T.C.No.10 of 2012 before the Special Officer under A.P (A.A) Tenancy Act, 1956cum-Junior Civil Judge at Gudivada.
The petitioner cannot be permitted to prosecute two parallel proceedings in respect of the same cause of action.
Hence, the Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall also stand dismissed.
