HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO TR.CRIMINAL PETITION No.139 of 2015 ORDER :

This is a petition numbered basing on the letter addressed by the learned V Additional District and Sessions Judge, Rayachoty, Kadapa District through the learned Principal District and Sessions Judge, Kadapa seeking to transfer S.C. No.194 of 2014 on the file of V Additional District and Sessions Judge, Rayachoty to the file of I Additional District and Sessions Judge, Kadapa.

2) The facts are that learned V additional District and Sessions Judge, Rayachoti submits that the Sessions Case No.194 of 2014 (P.R.C. No.36 of 2014) was assigned to him and on production of the accused and after fixing the schedule for trial, the learned Additional Public Prosecutor filed a memo stating that the trial was already held against A-2 to A-4 in Sessions Case No.19 of 2008 in the self same P.R.C.No.36 of 2007 before the learned I Additional District and Sessions Judge, Kadapa and after conclusion of the trial the case against the accused was acquitted on 27.02.2013 and requested to transfer the case to the file of I Additional District and Sessions Judge, Kadapa. Since the case was split up against accused No.7 and subsequently it was assigned as S.C. No.194 of 2014, the same was made over to the learned V Additional District and Sessions Judge. Basing on the memo of learned Additional Public

Prosecutor before the trial Court, the learned counsel for the accused also filed a memo expression his no objection to consider and transfer the case to the file of I Additional District Judge, Kadapa.

3) Perused of the letter addressed by the learned V Additional District and Sessions Judge, Rayachoty, Kadapa District and the relevant material on record.

4) In the result, the petition is allowed. The Sessions Case No.194 of 2014 from the file of learned V Additional District and Sessions Judge, Rayachoty is withdrawn and transferred the same to the file of learned I Additional District and Sessions Judge, Kadapa District.
