ORDER

This writ petition is filed seeking to declare the inaction of respondents 2 to 5 in taking action on the reports of the petitioners dated 4.12.2016 and 28.11.2016 against the unofficial respondents, as arbitrary and illegal.

Learned Government Pleader for Home produced before this Court the written instructions received from the Sub Inspector of Police, Nimmanapalli Police Station, Chittoor District, which reads as under: "It is submitted that basing on the said complaint, the 4th respondent-Station House Officer, Nimmanapalli Police Station, Chittoor District, enquired the matter and revealed that earlier on the private complaint of the petitioner herein received from the Hon'ble II Additional Judicial Magistrate of First Class, Madanapalli, a case was registered in Cr.No.23/2015 dated 9.5.2015 for the offences U/s.307, 326, 324, 323, 447, 147, 148 read with 34 IPC & Sec.156(3) Cr.P.C. against the respondents 6 and 7 herein and 5 others. During the investigation, seven (7) witnesses were examined and recorded their detailed statements.

The witnesses did not support the version of the witnesses. The Sub Divisional Police Officer, Madanapalli accorded permission to refer the case as "false" vide C.No.165/RCSDPO(M)/2015, dated 30.5.2015, 22.08.2015. After serving the notice to the complainant, the final report as "false" was filed before the Hon'ble II Additional Judicial Magistrate of First Class, Madanapalli."

In view of the same, the Writ Petition is closed. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 30th January, 2017 rkk
