HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.2485 of 2017 ORDER:

This criminal petition is filed by the petitioner/ A.1 under Sections 437 and 439 of Cr.P.C. to enlarge him on bail pending trial in SC No.109 of 2015 on the file of the I Additional Sessions Judge, Ananthapuram, registered for the offences punishable under Sections 120-B, 147, 148, 364-A, 368, 386, 324, 326, 506 read with 149 of IPC and Section 25(1-B) (a) of Arms Act. The petitioner is in judicial custody since 11.08.2014.

2. The main contention of the learned counsel for the petitioner is that the petitioner filed earlier bail application in Crl.P.No.8789 of 2015, which ended in dismissal by order dated 04.09.2015 and the second application in Crl.P.No.16190 of 2016 was also dismissed by this court by order dated 05.12.2016 on the ground that the schedule was already fixed by the Sessions Court and the petitioner was a habitual offender.

3. Even though the petitioner is in judicial custody since 11.08.2014, taking into consideration of the facts and circumstances of the case, this court negated the claim of the petitioner. At this stage, learned counsel for the petitioner requested this court to direct the Sessions Judge to dispose of the main case, as expeditiously as possible, as the petitioner is in pre-trial detention as under trial prisoner since 11.08.2014.

4. Acceding the request of the petitioner counsel, without going in to the merits of the case, I deem it appropriate to direct the I Additional Sessions Judge, Ananthapuram, to try and decide SC No.109 of 2015, as expeditiously as possible, in any event not later than three

months from the date of receipt of a copy of this order.
