THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14030 OF 2025 ORDER :
This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused seeking his enlargement on bail in connection with Crime No.2313 of 2025 of Gachibowli Police Station, Cyberabad Commissionerate. The offences alleged against the petitioner are under Section 69 and 318 of Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution is that on 10.10.2025 the defacto complainant gave a complaint stating that on 08.04.2025, she was introduced to Shaik Tajuddin Basha who is the petitioner herein through the matrimonial site Jeevansathi.com. They began speaking over the phone, during which he expressed his interest in marrying her and even spoke to her brother-in-law about the proposal. In May 2025, he called her to meet and took her to his house in Kondapur, where he physically engaged with her. When she asked about marriage, the accused claimed he had informed her sister and would inform others later. Subsequently, he blocked her. When she contacted him from another number, he falsely claimed to have
- 2 - cancer and said he was going abroad for treatment. Later, she got to know that the petitioner was already married, which he had suppressed from her. When confronted, he admitted that his wife was unhappy and he wanted to marry someone else, but now no longer he wished to marry her. Hence, she requested the police for taking necessary action against him. Based on her complaint, a case was registered against the accused for the above offences.

Heard Sri B. Akash Kumar, learned counsel for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.
The contention of learned counsel for the petitioner is that petitioner is innocent of the alleged allegations. The entire investigation in this case is already completed including the statement of victim and other witnesses. The victim and the petitioner are known to each other and victim voluntarily came to the hotel and the relationship between them is consensual relationship. The petitioner is in jail from 10.10.2025. Hence, requested this Court to grant regular bail to the petitioner. 5.
On the other hand, learned Additional Public Prosecutor opposed bail stating that the allegations against the petitioner
- 3 - are serious in nature and heinous offence. Investigation is at initial stage. The petitioner is a married person and under the promise of marriage he indulged in this heinous offence. As such, petitioner is not entitled for bail and prayed to dismiss this petition.

Considering the submissions made by the respective counsel and the material placed on record, the petitioner is in jail from 10.10.2025 and as seen from the record Lws.1 to 12 are examined including the investigating officer. Considering the period of incarceration of petitioner in jail, this Court deems it fit to grant bail to the petitioner subject to the following conditions :
i.
The petitioner/Accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of X-Additional Metropolitan Magistrate, Kukatpally at Prashanth Nagar, Cyberabad.
ii.
The petitioner/Accused shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.
iii.
The petitioner/Accused shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
