THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14098 OF 2025 ORDER :

This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, by the petitioner/A.6 seeking his enlargement on bail in connection with Crime No.312 of 2025 of Kachiguda Police Station, Hyderabad. The offences alleged against the petitioner are under Sections 64(2)(m), 87, 249(b) of Bharatiya Nyaya Sanhita, 2023, Section 5 r/w.6 of POCSO Act, and Sections 10 and 11 of Prohibition of Child Marriage Act.

The facts of the case are that on 10.09.2025 the defacto complainant lodged a complaint stating that his daughter who is aged about 17 years was missing from 09.09.2025 and he is having suspicion on A.1. Basing on the said complaint, police registered the case against the accused for the above offences. 3.

Heard Sri V.Raghunath, learned Senior Counsel appearing for K.Ajith Reddy, learned counsel for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioner is that the offences alleged against the petitioner herein are under

- 2 - Sections 249(b) of Bharatiya Nyaya Sanhita, 2023 and Sections 10 and 11 of Prohibition of Child Marriage Act. The petitioner is innocent of the said allegations and he is in jail from 10.09.2025. Except stating that A.1 and victim stayed in the house of petitioner herein there are no other allegations against him and petitioner is no way connected with the marriage of A.1 and victim. The entire investigation in this case is completed. As such requested this Court to grant regular bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail on the ground that the alleged offences against the petitioner are serious in nature. Hence, the petitioner is not entitled for bail and prayed to dismiss this petition. 6.

Considering the submissions made by both counsel and the material on record, the petitioner is in jail from 10.09.2025 and as seen from the record offences alleged against him are under Sections 249(b) of BNS and Sections 10 and 11 of the Prohibition of Child Marriage act. Considering the period of incarceration of petitioner in jail and progress in investigation that Lws.1 to 14 are examined, this Court deems it fit to grant bail to the petitioner subject to the following conditions : i.

The petitioner/A.6 shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only), with two sureties for

- 3 - a like sum each to the satisfaction of Special Judge for Trial of Cases under Protection of Children From Sexual Offences (POCSO)- cum-XII Additional Sessions Judge, Hyderabad.

ii.

The petitioner/A.6 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/A.6 shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
