HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.31451 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents 2 to 5 in trying to encroach petitioner' s land in Sy.No.69/ AA and 69/ E admeasuring Ac.3.00 gts., and Ac.6.10 gts., situated in Kamsanpally Village, Shadnagar Mandal, Ranga Reddy District, so as to demarcate the lands in Sy.Nos.70, 71 and 72 without following due process of law, as illegal, arbitrary and violative of principles of natural justice.

2) At the time when the matter is taken up for hearing, the Government Pleader for Revenue (TG), on instructions, states that the land in Sy.Nos.70, 71 and 72 are government lands and the lands in Sy.NoS.69/ AA and 69/ E are private lands. According to him, land in Sy.Nos.70, 71 and 72 has been alienated to Telangana State Live Stock Development Agency, Hyderabad, for establishment of New Frozen Semen Bull Station and accordingly, the Requisition Department took physical possession and fenced the said land. It is said that the respondents have nothing to do with the land in Sy.Nos.69/ AA and 69/ E, referred to above. Having regard to the above, it is urged that the question of respondents interfering with the land in Sy.Nos.69/ AA and 69/ E would not arise.

3) Recording the statement made across the Bar by the learned Additional Government Pleader with regard to nature of the land in Sy.No.69/ AA and 69/ E, the writ petition is disposed of, holding that if the petitioner is in possession and if any interference by any authority, it is open to the petitioner to avail the remedy available under law.

4) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
