THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 26597 OF 2016 ORDER:

Heard.

2. Questioning the action of the Sub-Collector, third respondent, in not disposing of appeal in ROC No.H/1501/2015 with reference to Survey No.58 admeasuring Ac.35-15 cents of Yanadivettu Village, Varadaqiahpalem Mandal, Chittoor District, petitioners have approached this court by this writ petition.

3. Against the orders of the Revenue Divisional Officer, dated 09.06.2016 granting stay on the appeal filed by the fifth respondent, petitioners approached the Joint Collector. The Joint Collector addressed a letter dated 18.06.2016 to the Sub-Collector requesting to dispose of the case within a period of four weeks and lifted the stay granted in the appeal.

4. Learned counsel for the petitioners submits that though there is a direction to dispose of the appeal within a period of four weeks, the third respondent has not taken any action thereof and there is an inordinate delay in disposing of the appeal.

5. The said contention of the learned counsel is not sustainable inasmuch as the third respondent is required to issue notice to the parties, conduct enquiry, and pass appropriate orders and hence, it cannot be said that there is any undue delay in implementing the orders of the second respondent.

6. In those circumstances, I deem it appropriate to direct the third respondent to dispose of the appeal in terms of the orders of the Joint Collector, as expeditiously as possible, preferably within a period of twelve (12) weeks from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. Miscellaneous petitions, if any pending in this writ petition, shall stand closed. No order as to costs.
