THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.1005 of 2016 ORDER :

This Criminal Petition is filed by petitioners under Section 438 Cr.P.C. seeking to grant anticipatory bail to them in an unregistered crime.

Heard and perused the material available on record. It is stated that petitioners are apprehending danger in the hands of the Respondent-Police, as they are threatening that they will book a false case under Section 498-A I.P.C. read with Sections 3 & 4 of Dowry Prohibition Act and other Penal Acts against petitioners and their family members at the behest of the Sister-in-law of the 1st and 3rd petitioners and co-sister of 2nd and 4th petitioners by name Neevarsu Meena, daughter of Seshagiri Rao, who had presented a report before the Respondent-Police.

Therefore, the petitioners apprehend arrest.

Learned Public Prosecutor submitted that no crime was registered against the petitioners.

Considering the above submission made by the learned Public Prosecutor, this Court is not inclined to grant the relief as prayed by petitioners.

However, the respondent-police concerned are directed to follow the procedure and issue notice

under Section 41-A Cr.P.C. to petitioners, if any case is registered against them.
