THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.20481 of 2017 ORDER:

Heard both sides. With the consent of both parties, the writ petition is disposed of at the admission stage. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents by calling the petitioner to the police station and harassing him, as illegal and arbitrary.

It is the case of the petitioner that the respondents are calling him to the police station and harassing him, without there being any crime registered against him.

Learned Government Pleader for Home, on instructions, submits that the allegations made in the writ affidavit are false. As seen from the record, there is no concrete material to show that the petitioner was illegally detained in the police station. But, having regard to the rival submissions made, the respondent police are directed to follow the procedure contemplated under law, if they intend to take any action against the petitioner.

Accordingly, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
