HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.9252 OF 2018 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, is filed by the Petitioner/Accused to quash the proceedings in Crime No.626 of 2018 of Meerpet Police Station, Rachakonda, registered for the offences punishable under Section 420 of I.P.C. and Section 7 of the Essential Commodities Act.

After arguing the case for awhile, learned counsel for the petitioner requested this Court to direct the concerned S.H.O. to follow the procedure under Section 41-A of Cr.P.C. and the guidelines issued by the Apex Court in Arnesh Kumar Vs. State of Bihar and another1. 3.

Acceding to the request of learned counsel for the petitioner, the Station House Officer, Meerpet Police Station, Rachakonda, is directed to follow the procedure under Section 41-A of Cr.P.C. and the guidelines issued by the Apex Court in Arnesh Kumar (supra). 4.

Accordingly, with the above directions, the Criminal Petition is disposed of.

Pending miscellaneous petitions, if any, in this Criminal Petition shall stand closed in consequence.
