Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

With the consent of both the parties, the Writ Petition is disposed of at the admission stage.

The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.3 in issuing proceedings under R.C.E2802/ 2016, dated 15.09.2015 and 26.07.2016 under R.O.R. Act and issuing notice to the petitioner directing him to appear before him on 15.10.2016 and 27.08.2016, as illegal and arbitrary, as finally adjudicated by the suit O.S.No.47 of 2016 on the file of the Junior Civil Judge, Koilakuntla.

Though various grounds are raised, learned counsel for the petitioner submits that the very issuance of notices dated 15.09.2015 and 26.07.2016 itself is illegal, when a civil suit is pending between the parties with regard to the land in dispute. 5.
It is to be noted that explanation has already been submitted by the petitioner to the impugned proceedings and hence the question of entertaining the writ petition against issuance of impugned notices does not arise.

In view of the above, I see no reason to entertain the writ petition. But, however, the petitioner is always at liberty to avail the remedies after passing of the order by the respondentauthorities. 7.
Accordingly, the writ petition is disposed of. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs.
