HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.9250 of 2018 ORDER :

This criminal petition filed under Sections 437 and 439 Cr.P.C. by the petitioners/A.1 to A.3 in Crime No.276 of 2018 of Mancherial Police Station, Mancherial District, registered for the offence punishable under Section 302 read with 34 IPC, dated 25.06.2018, of the alleged occurrence on that day.

Heard learned counsel for the petitioners and learned Public Prosecutor, representing the State, and perused the material on record. 3.

The accusation shows that A.1 and A.3 are the daughters of the deceased and A.2. A.1, when A.2 and A.3 caught hold of the deceased, beat the deceased with grinding stone on the head, from which he died instantaneously, it is in relation to the distribution of the retirement benefits of the deceased, a Singareni Colonies retired employee. The petitioners were arrested on 13.07.2018 and therefrom they are in judicial custody.

The petitioners are seeking regular bail with contentions that the learned Sessions Judge in Crl.M.P.Nos.744 and 820 of 2018 respectively, went wrong in dismissal of the two bail applications, they are innocent and are falsely implicated, they are ladies and suffering from ailments and they have to take care of their respective families and breadwinners, hence to enlarge. It is the contention of investigation mostly completed.

Learned Public Prosecutor opposed the bail application saying the investigation is still in progress.

A perusal of the First Information Report, remand report, earlier bail application dismissal orders and the present bail application averments referred supra from the above, no way reins to entitle the concession in favour of the petitioners at this stage. 7.

Accordingly, the criminal petition is dismissed from the propensity of the crime though the Court has to balance the personal liberty.
