THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41065 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the registration of FIR No.59 of 2016, as illegal and arbitrary.
The allegations made in the complaint lodged by the 3rd respondent against the petitioners are that the 1st petitioner married the 3rd respondent after getting divorced with his first wife and at the time of marriage, the 1st petitioner and his relatives promised the 3rd respondent that they would give land in Survey No.909/2 to an extent of 50 cents as security to her, but they did not give to her and that the petitioners are harassing the 3rd respondent physically and mentally for additional dowry. Basing on the said complaint, the 2nd respondent registered the same as FIR No.59 of 2016, for the offences under Section 498-A IPC and Sections 3 & 4 of the Dowry Prohibition Act. The main grievance of the petitioners is that the petitioners are apprehending threat of arrest.
Considering the grievance of the petitioners, the 2nd respondent is directed to complete the investigation in FIR No.59 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed.
