HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.6299 of 2013 O R D E R :

The petitioners who are accused Nos.3&4 in C.C.No.75 of 2013 pending on the file of XIII Additional Chief Metropolitan Magistrate at Hyderabad registered for the offences punishable under Sections 498-A IPC and Sections 4 & 6 of Dowry Prohibition Act, filed this petition under Section 482 of Cr.P.C., seeking to quash the proceedings against them.

On the earlier occasion, it was reported that the petitioners are intending to compromise the matter with the second respondent-complainant and on that ground, it is adjourned to today. Today, it is informed by the petitioners that they are not willing to compromise the matter. Heard the learned counsel on either side and perused the material available on record.

Learned counsel appearing for the petitioners contends that no specific allegations were made against the petitioners to attract the ingredients of the offences alleged in the complaint. He further contends that the petitioners are no way concerned with the marital life of the second respondent with A1 and as such, continuance of proceedings against the petitioners is nothing but abuse of process of law.

At this stage, this Court cannot go into the allegations made in the complaint, which can be decided by the trial Court only after full-fledged trial. No prima facie case is made out to quash the impugned proceedings at this stage.

The Criminal Petition is accordingly dismissed. Pending Miscellaneous Petitions, if any, shall stand closed.
