HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.9267 OF 2018 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioner/complainant to dispose of the C.C. No.626 of 2015, pending on the file of the Court of XVIII Additional Chief Metropolitan Magistrate at Secunderabad (For short, 'the trial Court'), as expeditiously as possible.

Heard the learned counsel for the petitioner and perused the material available on record.

In view of Section 143(3) of the Negotiable Instruments Act, 1881 (for short, 'the N.I. Act'), the case filed under Section 138 of the N.I. Act has to be disposed of within six (6) months from the date of filing of complaint but, on account of heavy pendency of cases with regard to the said provision, the trial Courts are not able to comply with the requirement under Section 143(3) of the N.I. Act. Therefore, keeping in mind the submission made by the learned counsel for the petitioner, the trial Court is directed to dispose of the C.C. No.626 of 2015, as expeditiously as possible, in any event not later than six (6) months from the date of receipt of a copy of this order.

Accordingly, with the above directions, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions, if any pending, shall stand closed.
