HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31276 OF 2018 O R D E R :

This writ petition is filed challenging the action of the 3rd respondent in not registering case against respondent No.4 and his henchmen basing on the complaint given by the petitioner through post dated 14.08.2018.

Learned Assistant Government Pleader for Home produced written instructions stating that after sending complaint through registered post, petitioner has not approached the respondent police for enquiry; that basing on the complaint of 4th respondent a case in crime No.217/2018, dated 14.08.2018 is registered against the petitioner; and that since the date of commission of offence the petitioner and other accused are absconding.

When petitioner has filed complaint, it is for the respondent police to take action on the same in terms of the guidelines issued by the Apex Court in Lalita Kumari v. Government of Uttar Pradesh (2014) 2 SCC 1.

In view of the same, the writ petition is disposed of directing the respondent police to take appropriate action on the complaint of petitioner by following the guidelines issued by the Apex Court in Lalita Kumari's case. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
