THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37955 OF 2016 ORDER:
The writ petition is filed by the petitioners seeking a writ of mandamus directing the respondents to discontinue the rowdy sheets pending against the petitioners vide Nos.43 and 41 respectively on the file of the fourth respondent and consequently, to direct the respondents not to harass the petitioners.
Heard and perused the material.
Learned counsel for the petitioners submits that the cases are registered against the petitioners before 2005 and no cases are pending against them from 2005 onwards, but the respondents are continuing the rowdy sheets against the petitioners. He further submits that whenever law and order problems arise in the area, the fourth respondent is visiting the work place of the petitioners and as such, he prays this Court to close the rowdy sheets against the petitioners.
Considering the facts and circumstances of the case, the petitioners are directed to make a representation to the fourth respondent stating that they are not involved in any of the crimes from 2005 onwards and on filing of such application, the fourth respondent is directed to consider the representation and pass appropriate orders. Further, the fourth respondent is directed not to visit the work place of the petitioners on the basis of the rowdy sheet pending against the petitioners. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 22.11.2016 pln
