HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5233 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/ accused Nos.2 to 6 under Section 482 Cr.P.C seeking to quash the proceedings in FIR No.65 of 2015 of Women Police Station, Ranga Reddy District, Cyberabad registered for the offences punishable under Section 498-A, 506 IPC and Sections 3 and 4 of D.P Act.

2) Heard learned counsel for the petitioners/ accused Nos.2 to 6, who are no other than mother and other relatives of A-1 and A-1 is no other than husband of de facto complainant of Crime No.65 of 2015 as well as learned public prosecutor representing State before admission and before ordering notice to 2nd respondent. Perused the material on record.

3) As the material falls short for this Court to admit the application even strenuously contending that the earlier litigation is pending between the parties and it is afterthought creating false jurisdiction as there is some incident taken place on 14.04.2015 at Champapet, thereby the Criminal petition is disposed of, giving liberty to the petitioners from their entitlement to concession of bail, to move regular bail application before the learned Magistrate concerned with notice to Additional public prosecutor and in such event, the learned Magistrate shall grant bail with necessary conditions

on the same day and their presence may be dispensed with thereafter pending investigation and final report and any cognizance, to summon if required therefrom. It is needless to say any further remedy is left open to them. 4 ) Miscellaneous petitions, if any pending, shall stand closed.
