HON'BLE SMT JUSTICE ANIS CRIMINAL REVISION CASE No.252 OF 2008 O R D E R:

This Criminal Revision Case under Sections 397 and 401 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C') is filed by the revision petitioner herein challenging the order dated 30.01.2008, passed by the IX Metropolitan Magistrate, Cyberabad, Kukatpally, in D.V.C.No.14 of 2007, whereunder and whereby the second respondent was granted Monitory relief under Section 20 of The Protection of Women from Domestic Violence Act, 2005, (for short 'the Act'), and the revision petitioner was directed to pay maintenance of Rs.5,000/- per month to her for food, clothing and shelter.

3. Both the learned counsel for the revision petitioner and second respondent represented that the second respondent was convicted by the learned V Additional district & Sessions Judge, (Fast Track Court), R.R.District in S.C.No.387 of 2011, for the offence punishable under Sections 302, 404 & 201 of the Indian Penal Code, 1860, (for short 'I.P.C') and was sentenced to undergo life imprisonment; that now she is in jail, and further she preferred an appeal in Crl.A.No.769 of 2013 on the file of this Court. Both the learned counsel also informed this Court that since she is in jail, there is no necessity for the revision petitioner to pay maintenance to her.

Therefore, in view of the submissions made by both the learned counsel, the order to pay maintenance to the second respondent at the rate of Rs.5,000/- per month for food, clothing and shelter is suspended till the second respondent get acquittal by the Court and come out from the jail. With this observation, the Criminal Revision Case is disposed of.

5. Miscellaneous petitions pending, if any, in this Criminal Revision Case shall stand closed.
