THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 31482 of 2018 ORDER:

It is the case of the petitioners that they became the owners of large extent of land situated in Thallada and Telagaram Revenue Villages of Khammam District, by inheritance. It is their further assertion that for regularizing the sada sale deeds alleged to have been executed by their father, respondents 5 to 59 have filed applications before the fourth respondent - Tahsildar, Thallada Mandal, Khammam District, who in turn, issued a notice, dated 10.02.2018 to the petitioners directing them to attend the enquiry on 15.02.2018 and submit oral or written objections, if any. It is also their assertion that on receipt of such notice, they submitted objections on 17.02.2018 by specifically stating that there were no sada sale deeds executed by the petitioners or their family members and they are all forged documents. Apprehending that the fourth respondent would not take into consideration their objections, the petitioners have filed this Writ Petition.

CKR, J WP.No.31482 of 2018 Learned Government Pleader for Revenue submits that the objections raised by the petitioners would be considered by the fourth respondent in accordance with law.

In view of the above and inasmuch as it is stated by the petitioners that they were issued notices and had submitted objections pursuant thereto, this Writ Petition is disposed of directing that before passing orders under Section 5-A of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971, as applicable to the State of Telangana, the fourth respondent shall consider the objections stated to have been submitted by the petitioners and provide them an opportunity of personal hearing.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
