Guguloth Soma, v. Guguloth Narasimha Swamy,
THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO C.R.P.No.2061 of 2014 ORDER:
Heard Sri H.Venugopal, learned counsel for the petitioners and Sri A.Raghurama Autova, learned counsel for the respondent.
2.
This Revision Petition is filed challenging the Order dt.24-03-2014 in E.A.No.108 of 2013 in E.P.No.469 of 2013 of the II Additional Junior Civil Judge, Warangal.
3. Petitioners herein had suffered an ex parte decree in the above suit on 29-03-2013. They had to file I.A.No.1720 of 2013 under Section 5 of the Limitation Act, 1963 to condone delay of 135 days in filing application to set aside the ex parte decree.
4.
The application to set aside the ex parte decree was dismissed by the Court below on 24-032014. The same has been confirmed in C.R.P.No.2178 of 2014 by a separate order passed today.
5.
In that view of the matter, no stay of proceedings in the E.P.No.469 of 2013 as sought by the petitioner in E.A.No.108 of 2013 can be granted. Therefore as a consequence of dismissal of C.R.P.No.2178 of 2014, this Civil Revision Petition is also dismissed. No costs.
6.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
