THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.12984 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.4 in NDSC.No.240 of 2022 on the file of Metropolitan Sessions Judge, MedchalMalkajgiri District, registered for the offences under Section 8 (c) r/w. 22 (c), 22A, 28 and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act'). 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

This Court by order dated 18.12.2023 granted the relief of regular bail to A-3 on the ground that the respondent-NCB authorities failed to conclude the trial though undertook to complete the trial expeditiously before this Court and also before the Hon'ble Supreme Court.

Learned Special counsel appearing for NCB would submit that all steps have been taken to expedite the process of trial and sought for dismissal of bail application.

On the ground of parity, this petitioner is also entitled to be released on bail, subject to following conditions:- i) The petitioner/Accused No.4 shall be released on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of the Metropolitan Sessions Judge, Medchal-Malkajgiri District.

ii) The petitioner/Accused No.4 after release shall appear before the concerned Court on every date of hearing. iii) The petitioner/Accused No.4 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
