THE HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.25894 of 2008 ORDER :

The petitioner preferred this Writ Petition against the 1st and 2nd respondents on the ground that he is the General Power of Attorney of 3rd and 4th respondents. When the matter posted for hearing, this Court perused the records. The 3rd and 4th respondents filed an application before this Court informing that the petitioner is not their General Power of Attorney and they never executed any such power of attorney in favour of the petitioner herein. In view of the above, this Court is of the view that when such a stand is taken by the 3rd and 4th respondents, the Writ Petition cannot be proceeded further unless and until the dispute between the petitioner and the 3rd and 4th respondents is settled by the competent civil Court.

Hence, the Writ Petition is disposed of directing the petitioner to obtain appropriate orders from the civil Court to proceed further in this matter. No order as to costs.
