THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.13143 of 2014 ORDER:
This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the Petitioners to quash proceedings in Cr.No.101 of 2014 on the file of the Station House Officer, Kodimial Police Station(L& O), Karimnagar district, outcome of private complaint of the 2nd respondent-defacto-complainant filed before the II Additional Judicial Magistrate of First Class at Jagityal, that was referred to police for investigation under Section 156(3) of Cr.P.C. which is registered for the offences punishable under Sections 406,420 and 506 read with 34 of I.P.C. on the report of.
2. Heard the learned counsel for the petitioners so also the learned Public Prosecutor representing State-1st respondent and 2nd respondent-de facto-complainant and perused the material on record.
3. As the material falls short for this Court to admit the application under Section 482 of Cr.P.C. to quash the proceedings in the above crime but for entitlement to the concession of bail from the factual matrix, the Criminal Petition is disposed of giving liberty to the petitioners to surrender before the learned Magistrate concerned and move an application for regular bail with a notice to the learned Public Prosecutor, in such an event, the learned Magistrate shall grant bail to the petitioners preferably on the same day with necessary conditions. Needless to say at post-bail stage, pending investigation, their personal appearance before the Court can be dispensed with. Needless to say in the event of police filing final report and cognizance is taken by the Magistrate, further remedies are left open to the petitioners.
4. Consequently, miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
