THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO W.P.No.8021 of 2015 O R D E R:
This writ petition is filed by a Field Assistant functioning under the Mahatma Gandhi National Rural Employment Guarantee Scheme, calling in question the correctness of placing him under suspension pending inquiry, through the impugned order dated 23-02-2015.
After hearing the learned counsel for the petitioner on the previous occasion, I directed Sri M.S.R. Chandra Murthy, learned Standing Counsel for the respondents, to produce the record as to whether the allegations against the petitioner have been trumped up lately due to political considerations or there was some material against him.
Today, the learned Standing Counsel has produced the record. It discloses that the Assistant Project Director, Pathikonda Cluster, as on 28-11-2014, after conducting a local inquiry, has filed an adverse report against the functioning of the petitioner. Another communication there after was also sent on 19-02-2015. In that view of the matter, it was considered appropriate to place the petitioner under suspension and, in fact, a detailed show cause notice was also issued requiring him to answer the serious allegations framed against him. It is now stated by the learned Standing Counsel that the said show cause notice was dispatched to the petitioner. In that view of the matter, I hope and trust that the inquiry initiated against the petitioner will be completed as expeditiously as is possible, at any rate, within a maximum period of three months from the date of receipt of a copy of this order, duly providing a fair and reasonable opportunity to the writ petitioner to participate in the inquiry and establish his defence.
With this, the writ petition stands disposed of at the admission stage, but however, without costs.
Consequently, the miscellaneous petitions, if any, stand disposed of. __________________________
