HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.6008 OF 2017 ORDER:

This writ petition is filed for a writ of Mandamus declaring the action of the respondents in seeking to dispossess the petitioners and interfering with their rights over the land in Survey Nos.318/1, 318/2, 353 and 354, admeasuring Ac.08.30 guntas, situated at Christianpalli Village, Mahabubnagar town and District, as illegal and arbitrary and for a consequential direction to the respondents not to interfere with the rights of the petitioners over the said land, without following due process of law.

Learned counsel for the petitioners submits that there is a civil dispute between petitioners and respondents 7 and 8 along with others in OS.No.10 of 2015 and petitioners obtained injunction in IA.No.33 of 2015 on 23.01.2015 against respondents 7 and 8 and others. But, the official respondents herein are trying to interfere with the possession of the petitioners.

Learned Assistant Government Pleader on instructions submits that the subject land is purely a private land and respondents have nothing to do with the said land. Recording the aforesaid submission of the learned Assistant Government Pleader, the writ petition is disposed

of. However, it is open for the petitioners to workout his remedies in civil suit in OS.No.10 of 2015. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending, shall stand closed.
