THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.14388 OF 2017 ORDER:

The petitioner states that an extent of 290 square yards situated in Survey No.405/1 in Tilaknagar, Eluru, was donated by one Pudi Appalaswamy in the year 2001 under registered document No.11565 of 2001 in favour of Tilak Vidya Vignanik Seva Kendram for establishment of a community centre for the public purpose. Thereafter, a building was constructed in the year 200203 with the funds raised by a Member of Parliament and it was registered on 10.10.2001 in the name, "Tilak Vidya Vignanik Seva Kendram, Eluru" under the Societies Registration Act, 1860. The committee of the said Society has been maintaining the aforesaid community hall since the date of construction. While so, the respondents 3 to 9 started construction of a temple in the aforesaid premises without obtaining any permission from the authorities concerned.

In that connection, the petitioner, being Secretary of Communist Party of India, submitted representations dated 21.03.2016, 28.03.2016 and 04.04.2016 for removal of the structures, which were raised in the subject premises without obtaining any permission. As no action is taken on the said representations, the present Writ Petition is filed. In the circumstances, the Writ Petition is disposed of directing the second respondent to consider the representations dated 21.03.2016, 28.03.2016 and 04.04.
