O R D E R:- The petitioner claims to be absolute owner and possessor of an agricultural land admeasuring Ac.3.60 cents and Ac.1.50 cents in Sy.No.601 situated in Cherukumudi village polam, Manubolu Mandal, S.P.S.R. Nellore District having purchased the same from her vendor namely Kondreddi Chandra Reddy whose name has been entered in the revenue records as pattadar. While so, it is stated that the 4th respondent - Tahsildar, without any notice and without giving any opportunity of being heard, issued proceedings dated 14.11.2011 indicating resumption and transfer of land in an extent of Ac.3.60 cents to her vendor. It is further stated that on 11.04.
2012, even though the petitioner challenged the proceedings of the Tahsildar in appeal along with an application seeking stay of dispossession, the 3rd respondent, till today has neither disposed of the appeal nor passed any orders on the stay application, moreover, the petitioner's grievance is that the respondents, without following due process of law, are threatening to dispossess her forcibly from the land in question wherein there is standing paddy crop. Hence, the present writ petition is filed seeking appropriate directions.
Heard the learned counsel for both the parties and perused the material placed on record.
Considering the fact that the appeal said to have been
filed by the petitioner before the 3rd respondent-Revenue Divisional Officer, has been pending adjudication since 11.04.2012, this Court deems it appropriate to direct the 3rd respondent to dispose of the appeal within a period of four months from today. Till such time as the appeal is disposed of, there shall be interim stay of all further proceedings in pursuance of the impugned order dated 14.11.2011 passed by the 4th respondent.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel to the disposal of the writ petition, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
