ORDER:

This Civil Revision Petition arises out of order, dated 22.07.2014, in I.A.No.501 of 2014 in OS.No.237 of 1982 on the file of learned Principal Junior Civil Judge, Ranga Reddy District.

The petitioner is a third party to the abovementioned suit filed by one E.Raj Kumar, who is no more.

The petitioner filed the above-mentioned Interlocutory Application under Rule-188(2) of Civil Rules of Practice for supply of certified copies of plaint, written statement, Exs.A-1 to A-3 and Exs.B-1 to B-9. The said application was partly dismissed by the lower Court on the finding that on 04.04.1997, the original plaintiff appeared to have taken away the original documents marked as Exs.A-1 to A-3 leaving only their photo copies and that therefore, the certified copies of the said

documents cannot be issued. As regards the plaint, written statement and Exs.B-1 to 9, the application was allowed subject to payment of copy application charges. At the hearing, it is not disputed by Sri T.L.Kantha Rao, learned counsel for the petitioner, that in the absence of original documents, it is not permissible to grant certified copies of photo copies of Exs.A-1 to A-3. Therefore, the lower Court has not committed any error in rejecting the application of the petitioner to the extent of the prayer for grant of certified copies of Exs.A-1 to A-3.

For the above-mentioned reasons, the Civil Revision Petition is dismissed.

As a sequel to dismissal of the Civil Revision Petition, CRPMP.No.5957 of 2014 filed by the petitioner for interim relief is dismissed as infructuous. ____________________________ JUSTICE C.V.NAGARJUNA REDDY 30th January 2015 DR
