THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.12954 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused Nos.1 to 7 seeking bail in the event of their arrest in connection with Crime No.141 of 2023 on the file of Koheer Police Station, Sangareddy District, registered for the offences under Sections 324, 323, 356 and 504 r/w. 34 of IPC.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The de-facto complainant is the brother of A-1 and son of A-5. A-3 and A-4 are also the brothers of de-facto complainant. In relation to property disputes, it is alleged that there was an altercation and these petitioners allegedly attacked the victim. 4.

It appears that there was fight amongst the siblings regarding property. In the said fight, three of them received injuries.

Keeping in view that there are disputes between family members regarding property, the relief of anticipatory bail can be granted, subject to following conditions:-

1) The petitioners/Accused Nos.1 to 7 are directed to surrender before the Station House Officer, Koheer Police Station, Sangareddy District, on or before 10.01.2024. Upon such surrender, the said Station House Officer shall release the petitioners/Accused on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, for a like sum each to his satisfaction.

2) On such release, the petitioners/Accused Nos.1 to 7 shall appear before the concerned Station House Officer on every Monday at 10:00 a.m. for a period of four weeks for the purpose of investigation and thereafter, as and when required.

3) The petitioners/Accused Nos.1 to 7 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
