HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.31263 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the 3rd respondent in not considering the representation dated 30.07.2018, submitted by the petitioner seeking to seize unauthorised bore well sunk by the 6th respondent in the land situated in Sy.No.892B/2A, Palavai Village, Kalyanadurgam Mandal, Ananthapuramu District, as illegal and arbitrary.
The grievance of the petitioner appears to be that the bore well is being used un-authorisedly by the unofficial respondent herein and as such he is said to have made a representation to the 3rd respondentTahsildar, to take appropriate action against the 6th respondent. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 3rd respondent-Tahsildar, to deal with the representation dated 30.07.2018, submitted by the petitioner and pass appropriate orders, in accordance with the provisions of the WALTA Act, 2002, as early as possible, preferably within a period of six to eight weeks from the date of receipt of copy of this order, after giving the reasonable opportunity of hearing to the petitioner and all concerned. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
