HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.No.15769 of 2013 ORDER:
Petitioners-A1 to A3 have filed this petition seeking quashing of the proceedings in P.R.C.No.18 of 2010 on the file of the Court of the Judicial Magistrate of First Class, Kodur, Kadapa District.
On a complaint given by the 2nd respondent herein, a case in Crime No.55 of 2009 was registered against the petitioners-A1 to A3 by the Sub Inspector of Police, Obulavaripalli Police Station for the offences punishable under Sections 506, 384 read with Section 34 I.P.C. and Section 3 (1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Eventually, after completion of investigation, a charge sheet was laid under the aforesaid offences against the petitioners-A1 to A3 in the Court of the Judicial Magistrate of First Class, Kodur, Kadapa District.
When this matter is taken up for hearing, it is brought to the notice of this Court by the learned Counsel for the petitioners as well as the learned Counsel for the 2nd respondent-complainant that the parties have entered into compromise at the instance of elders and to that effect they filed a joint compromise memo.
The said joint compromise memo, which is signed by the parties and their Counsel, is accompanied by a petition i.e., Crl.M.P.No.14130 of 2013. The petitioners-A1 to A3 also
filed Crl.P.M.P.No.14129 of 2013 seeking to compound the offences alleged against them since the parties have arrived at a compromise.
On 31.12.2013, both the parties were present before this Court and they were identified by their respective Counsel. This Court when examined the 2nd respondentcomplainant, he stated that he has settled the dispute with the petitioners-accused and has no objection to quash the proceedings initiated against them.
In the light of the compromise arrived at between the parties, the compromise memo filed by both the parties is recorded and Crl.M.P.No.14130 of 2013 is ordered. Further, Crl.M.P.No.14129 of 2013 is also ordered and the offences alleged against the petitioners-A1 to A3 are compounded. Accordingly, the Criminal Petition is allowed and the proceedings initiated against the petitioners-A1 to A3 in P.R.C.No.18 of 2010 on the file of the Judicial Magistrate of First Class, Kodur, Kadapa District, are hereby quashed in terms of the compromise entered into between the parties. _________________ M.S.K.JAISWAL, J 01-07-2015 Gsn
