THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.2403 OF 2018 ORDER:

Though the matter appears under the caption 'for withdrawal', it is not open to the petitioner in a Contempt Case to seek its withdrawal after institution, as the act of contempt, if any, would have to be adjudicated upon and it is not open to the petitioner to seek withdrawal of the case thereafter. However, perusal of the order dated 05.07.2017 passed in WPMP No.26900 of 2017 in W.P.No.21857 of 2017, which led to the filing of this Contempt Case, demonstrates that this Court directed the authorities not to interfere with the possession and enjoyment of the petitioners over certain extents of land in Sy.No.1301 of Siddipet Village, pending further orders. The Contempt Case was instituted alleging disobedience to this order.

While so, Sri Baskula Athik, learned counsel for the petitioners, would inform this Court that the Tahsildar, Siddipet Mandal, Siddipet District, promised to offer some alternative land to the petitioners and therefore the petitioners are no longer interested in pursuing this Contempt Case. As it is stated that the petitioners themselves are negotiating with the authorities for settlement of the main dispute that would arise in the Writ Petition and they have been offered some other alternative land, this Contempt Case no longer deserves adjudication on merits. The Contempt Case is accordingly dismissed. I.A.No.1 of 2018 also stands dismissed. No order as to costs.
