THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14101 of 2025 ORDER:
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of prearrest bail to the petitioner, who is arrayed as accused in Crime No.573 of 2025 on the file of the Ameenpur Police Station, Sangareddy, registered for the offences punishable under Sections 69 and 351 (2) of BNS.

The brief facts of the case for the prosecution are that on 25.09.2025, the de facto complainant lodged a report before the police stating that she is about 34 years of age and that she became acquainted with the petitioner, who is an Aerospace Engineer, in the year 2022. She stated that the petitioner expressed his love for her and eventually, she accepted his proposal. The petitioner promised to marry her and engaged in sexual intercourse with her. He continued the relationship with her until 2025, after which he stated that he had only loved her for time pass and that he would not marry her. Hence, the complainant requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offences.

Heard Sri R.Sushanth Reddy, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner and the complainant have a consensual relationship and that there was no such promise of marriage. They have known each other since the year 2022, and both are majors. In fact, the de facto complainant is elder than the petitioner. He further submits that no offence has been committed by the petitioner and that custodial interrogation is not required in this case. The petitioner is ready to cooperate with the investigating officer. Therefore, prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition. 5.
On the other hand, the learned Additional Public Prosecutor is opposing the submissions made by the learned counsel for the petitioner, stating that the allegations against the petitioner are serious in nature. In view of the gravity of the offences, the petitioner is not entitled to anticipatory bail and prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that, even according to the de facto complainant, the relationship has been in existence since the year 2022, and that she lodged complaints on
01.07.2025 and 25.09.2025. Therefore, this Court deems it fit to grant pre-arrest bail to the petitioner/accused, subject to the following conditions:
i.
The petitioners/Accused shall surrender before the Station House Officer, Ameenpur Police Station, Sangareddy, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail, on petitioner executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.
ii.
The petitioner/Accused shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner/Accused shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.
