THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3403 of 2015 ORDER:
The writ petitioner questions the inaction of the 2nd respondentTahsildar in disposing his application dated 29.09.2014.
2. The petitioner's case, precisely, is that he submitted an application to the 2nd respondent seeking permission to dig a bore well in his agricultural land in the year 2011; upon which the 2nd respondent issued a certificate on 02.11.2011. Subsequently, he dug a bore well and approached the electricity authorities for electricity connection, who stated that the certificate produced by the petitioner does not show any permission to dig bore well and hence electricity connection cannot be provided. He made several visits to the 2nd respondent's office and made an application again on 29.09.2014, but in vain.
3. Grant of permission for digging of bore wells/any well, as defined under Section 2(22) of the A.P. Water, Land and Trees Act, 2002 (for short, 'the Act'), is governed by Section 13 of the Act read with guidelines issued under G.O.Ms.No.227 dated 08.04.2013. It is not necessary to mention the details of G.O.Ms.No.227, except to state that there are certain formalities that are required to be complied with before a person can dig a well.

Hence, this writ petition is disposed of directing the 2nd respondentTahsildar to pass appropriate orders on the petitioner's application dated 29.09.2014, in accordance with law, within a period of three weeks from the date of receipt of a copy of this order. No costs. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
