HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 31256 of 2018 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the 4th respondent/ Joint Sub-Registrar in refusing to register the sale document to be presented in respect of the petitioner's land to an extent of Ac.1.00 in Sy.No.608/ 2 of Kalluru Village, Kurnool SubDivision, Kurnool District, as illegal and arbitrary. 2) The Government Pleader for Revenue (AP), on instructions, states that the reason for refusing the registration is that the land admeasuring Ac.19.40 cents in Sy.No.608/ 2 of Kallur Village, Kurnool District, is endowment land, which came to be received vide Lr.Rc.No.M1/ 9581/ 2016, dated 05.07.2016 from the Commissioner, Endowments Department, Hyderabad. Hence, the same cannot be registered.
3) Having regard to the above, it appears that since the reason for not registering the document was not communicated to the petitioner, he has approached this Court. Hence, the Writ Petition is disposed of, directing the respondents to forthwith communicate the reason for not registering the document, in which event the petitioner shall avail the remedy available under law.
4) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
