HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition Nos.11590 and 11592 of 2017 Common Order:
These two Writ Petitions are being disposed of by this common order as they are filed by the students who stated to have pursued D.Ed course in Urdu medium in the sixth respondent college. It is their case that they appeared for the common entrance examination and obtained ranks. They were allotted to the sixth respondent college and the sixth respondent college, which is a minority institution, imparted D.Ed course to them. The examinations are commencing from 17.04.2017 and in view of the denial of permission to appear for the examination, the present Writ Petitions are filed challenging the proceedings dated 17.10.2016 issued by the Director of School Education-cum-Chairman, DEECET 2015, Government of Telangana, Hyderabad.
A reading of the impugned order dated 17.10.2016 shows that there was no permission to admit Urdu medium students in the D.Ed colleges run by the Minority Educational Institutions as there was no infrastructure. In those circumstances, in the 3rd phase of counseling, the Convener addressed a letter on 26.05.2016 informing the minority colleges that only Telugu medium students should be admitted, as there is no permission to run Urdu medium in minority D.Ed colleges. It was noticed that out of 650 seats filled, 534 candidates belonged to Telugu medium and 116 candidates belonged to Urdu medium and six minority colleges admitted the Urdu medium candidates against the Rules without permission of the Government/Department. A reading of the impugned order also reveals that the students were admitted without making adequate arrangements to handle classes for Urdu medium by appointing
suitable faculty, required books/magazines/journals in Urdu language. Though the Convener at one point of time, vide his letter dated 21.07.2016 addressed to the Principal Secretary to Government, recommended the case of six minority colleges for admission of Urdu medium students, the said request was rejected by the impugned order dated 17.10.2016. The copy of letter dated 26.05.2016 prohibiting the admission of Urdu medium students is not filed along with the present Writ Petitions. It appears that way back in May 2016 the colleges were informed not to admit Urdu medium students and in spite of the same, it appears that the petitioners were admitted by the respective colleges. In the absence of any orders of the Government permitting the admission of students, no relief can be granted to the petitioners. However, it is open to the petitioners to take appropriate steps against the respective managements, if the petitioners are aggrieved. The Writ Petitions are, accordingly, dismissed. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in these Writ Petitions shall stand closed.
