HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.40843 OF 2014 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the respondents in not taking any action on the representations dated 30.09.2014, 01.12.2014 and 12.12.2014 and in not stopping the unauthorized constructions being undertaken by the 3rd respondent, as illegal and arbitrary and for a consequential direction to the respondents to dispose of the above said representations made by the petitioners. The case of the petitioners is that their fathers are the protected tenants of Ac.2.25 grs in Sy.No.47, and Ac.1.29 gts in Sy.No.48 of Pedda Amberpet Village, respectively, and after the death of the original protected tenants, the petitioners were recognised as legal heirs and were given Succession Certificates by the competent authority and they were put in possession of the said lands on 03.06.

2009, pursuant to the orders passed in proceedings No.B/15308/2007 & No.B/15309/2007, dated 04.10.2008, by the Deputy Collector & Tahasildar, Hayathnagar Mandal, Ranga Reddy District and the same has become final. But, the unofficial respondents 3 to 5 are making constructions on the said land without taking any permission from the 2nd respondent. Aggrieved by the same, the petitioners submitted their representations to the 2nd respondent dated 30.09.2014, 01.12.2014 and 12.12.2014, bringing the true facts into their notice. But, no action has been taken. Aggrieved by the same present writ petition is filed.

Heard learned counsel for the petitioners.

Sri D.Bhaskar Reddy, learned Standing counsel for the 2nd respondent, on instructions submits that necessary action has been initiated in pursuance to the representation of the petitioners.

In view of the above, the 2nd respondent is directed to consider and dispose of the representations dated 30.09.2014, 01.12.2014 and 12.12.2014 within a period of three weeks from the date of receipt of a copy of this order and take action according to law. Accordingly, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
