On 02.01.2010 petitioner was appointed as Engineering Consultant to Porumamilla Mandal under Mahatma Gandhi National Rural Employment Guarantee Scheme. On 18.04.2016 proceedings were initiated holding that wrong entry was made in the M Book on the quantum of work executed. Preliminary enquiry was conducted and based on the report, allegation was levelled against the petitioner and he was temporarily kept under suspension. Petitioner was called upon to submit his explanation. On 27.04.2016 petitioner submitted detail explanation. Alleging inaction in taking final decision and continuing him under suspension, this writ petition is filed.

Since charge was levelled against the petitioner on 18.04.2016 and as petitioner has already submitted his explanation, this Court is not inclined to entertain and to keep the writ petition pending.

Accordingly, the Writ Petition is disposed of directing the Project Director, District Water Management Agency (2nd respondent), to examine the explanation submitted by the petitioner and pass final orders. A decision to this extent shall be taken within a period of four (4) weeks from the date of receipt of copy of this order and shall be communicated to the petitioner by assigning due reasons in support of the same. For any reason no

- 3 - final orders are passed within the time stipulated, petitioner shall be reinstated into service. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
