The case of the petitioners is that they are the residents of houses situated in Sy.No: NTS 387/23/A1,C1 AIN Layout No.4/89 and Plot Nos. 15, 15B, 16, 17, 18, 19 and NTS 387/23 A1, C1, A respectively for the last 20 years vide patta No.Rc.B.543/1995, dated 11.04.1995. While so, the 6th respondent for the purpose of erecting 50 ft rock idle of Sri Jagadguru Sankaracharya is trying to dispossess the petitioners from their houses without following due process of law, though they were granted pattas by the then Revenue authorities. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.
Learned counsel appearing for the 6th respondent on instructions submits that they would follow due process of law in case they want to evict the petitioners.
In view of the above said submission, the writ petition is disposed of directing the respondents not to evict the petitioners without following due process of law. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
