HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.42212 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: " ... to issue a writ, order or a direction, more particularly one in the nature of writ of mandamus, declaring the action of the 4th respondent in not implementing the ryotwari patta granted by the Inams Deputy Tahasildar vide SR No.31/13, IDT No.207 of 2012, dated 17-6-2013 for an extent of 0.27 cents in Survey No.233/1P of Tiruchanur Village, Tirupati Rural Mandal, Chittoor District by disposing of representations of the petitioners dated 6-2-2014, 7-52015 and 23-6-2016, as being arbitrary, illegal, unreasonable and violative of Articles 14 and 300 (A) of the Constitution of India and issue a consequential direction directing the Tahasildar to forthwith implement of ryotwari patta dated 17-6-2016 in the village accounts on to the name of the petitioner and pass such other order or orders as this Hon'ble Court deems fit and proper."

Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to dispose of the representation made by the petitioner on 23.06.2016 at the earliest.

Learned AGP would submit that a suitable direction may be given to the 4th respondent to dispose of the representation, if the same is still pending consideration, in accordance with law. Having considered the rival submissions made, the writ petition is disposed of directing the 4th respondent-Tahasildar to consider the representation made by the petitioner on 23.06.2016 for not implementing the ryotwari patta granted by the Inams Deputy Tahasildar vide SR No.31/13, IDT No.207 of 2012, dated 17-6-2013 for an extent of 0.27 cents in Survey No.233/1P of Tiruchanur Village, Tirupati Rural Mandal, Chittoor District and pass necessary orders thereon, in accordance with law, after hearing the petitioner and other aggrieved persons, if any, as early as possible, preferably within a period of 4-6 weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
