THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40782 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the fourth respondent in interfering into family matter by calling him to the police station, threatening with dire consequences and physically bet the family member of the petitioner as illegal and arbitrary and consequently direct the fourth respondent not to interfere in the family issue of the petitioner. Heard and perused the material.

Learned counsel for the petitioner submits that there is a dispute between the petitioner and his wife, fifth respondent. He further submits that at the instance of the fifth respondent, the fourth respondent is interfering with family affairs of the petitioner and is calling the petitioner and his family members to the police station and threatening them with dire consequences and compelling the petitioner to settle the matter with the fifth respondent . Hence, he prays this Court to direct the fourth respondent not to interfere with the family affairs of the petitioner. Learned Assistant Government Pleader for Home (Telangana) submits that the fourth respondent is not interfering with the family affairs of the petitioner.

Considering the rival submissions of the learned counsel for the petitioner and the Assistant Government Pleader for Home (Telangana), and also considering the facts and circumstances of the case, the fourth respondent is directed not to interfere with the family affairs of the petitioner without therebeing any complaint registered against the petitioner and also not to call the petitioner and his family members to the police station. The fourth respondent is also directed to follow due process of law laid down in Code of Criminal Procedure.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 24.11.2016 pln
