27.04.2026 SKS, J I.A.No.1 of 2026 This application is filed by the petitionerA.2 seeking to relax the condition Nos.(ii) and (ix) i.e., return of the passport and permit the petitioner to travel to Male (Maldives) for a period of one month.
Learned counsel for the petitioner would submit that the petitioner was a business person having work in Maldives on business purpose. He required his passport to travel to the said place for a period of one month. He further submits that earlier also he filed applications relaxation of condition and this Court relaxed the condition for three months and returned the passport to the petitioner. The petitioner re-deposited the same and therefore, the petitioner sought to relax condition Nos. (ii) and (ix) once again and to permit him to travel to Maldives.
Learned Assistant Public Prosecutor reported that if the petitioner would re-deposit his passport and furnishes his travel details, there is no objection for conceding his request.
Considering the fact that the offence was pertaining to the year 2022 and trial had not yet
commenced and on account of the deposit of the passport of the petitioner, the fundamental right of petitioner to travel Abroad cannot be curtailed. Considering the submissions of the learned counsel for the petitioner, it is considered fit to allow the petition directing the learned I Additional Special Judge for SPE & ACB Cases to release the passport of the petitioner-A2 temporarily for a period of one month and granting him permission to travel to Maldives from the date of receipt of copy of this order. After return from Maldives, the petitioner shall re-deposit the passport before the learned trial Court concerned immediately. He has to inform his itinerary and date of arrival to India to the learned trial Court.
In the event of above conditions not complied with, the learned trial Court to initiate the proceedings to cancel the surety amounts, which were given at the time of granting bail. Accordingly, the application is ordered relaxing condition Nos.(ii) and (ix) and permitting the petitioner to travel to Maldives for a period of one month.
