HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 8796 of 2017 ORDER:

The grievance of the petitioner is that, while the respondent - Corporation (VUDA) master plan would show a road in Sy.No.8, sub-division 3C, Kurmannapalem Village, Gajuwaka Mandal, Visakhapatnam District, which was approved by the Corporation in 1981 under the name and style of 'Ramanagar Layout', the road has been encroached upon by some private parties. Bringing this aspect to the notice of respondent No.2, the petitioner made a representation on 05.12.2016, and no action is being taken. He states that, on earlier occasion, respondent - authorities had, in fact, removed the encroachments and, once again, encroachments are going unabated only on account of inaction of the respondent - Corporation.

Sri S.Lakshmi Narayana Reddy, learned Standing Counsel for respondent - Corporation, on instructions, would submit that necessary action would be taken in accordance with law. He would also assert that it is also the responsibility of the petitioner to approach appropriate Civil Court to protect their property and protect easementary rights if any. In the circumstances, the Writ Petition is disposed with a direction to the respondent - authorities to take appropriate action on the petitioner's representation dated 05.12.2016 in accordance with law.

Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
