HON'BLE Dr. JUSTICE CHILLAKUR SUMALATHA CRIMINAL PETITION No.10723 of 2022 ORDER:
This Criminal Petition is filed seeking the Court to relax the condition that is imposed upon the petitioners while granting bail through order in Crl.M.P.No.4179 of 2022 on the file of the Court of I Additional Metropolitan Sessions Judge, Hyderabad, dated 01.11.2022, in Crime No.159 of 2022 of R.P.S.Kachiguda Police Station, Hyderabad. 2.
Heard Sri Suresh Singh, learned counsel for the petitioners, as well as the learned Additional Public Prosecutor who is representing the respondent-State. 3.
Learned counsel for the petitioners states that though the petitioners were directed to be enlarged on bail, they were directed to execute a personal bond for Rs.50,000/- (Rupees Fifty thousand only) with two sureties for the like sum each and as the petitioners are unable to secure such solvency, they are still in jail and therefore, the amount of solvency may be reduced to Rs.20,000/-.

Learned Additional Public Prosecutor, on the other hand, states that the petitioners hails from Uttar Pradesh.

As per the material available on record, the petitioners were granted bail by the Court below on 01.11.2022. The fact that the petitioners are still in judicial custody i.e., for a period of more than one month from the date of the said order itself goes to show that they are unable to furnish such solvency. Therefore, this Court considers it desirable to honour the request of the petitioners.

Hence, this Criminal Petition is allowed and the order by which bail is granted to the petitioners, i.e., the order rendered in Crl.M.P.No.4179 of 2022 on the file of the Court of I Additional Metropolitan Sessions Judge, Hyderabad, dated 01.11.2022, in Crime No.159 of of R.P.S.Kachiguda Police Station, Hyderabad, is hereby modified to the extent of furnishing solvency for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for the like sum to the satisfaction of the Court concerned.
