THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.2794 of 2016 ORDER:
The grievance of the petitioners is that they are sought to be dispossessed from their lands without following the due procedure laid down by law. The basis for this grievance is that the respondent authorities are undertaking survey and marking operations on the petitioners' lands.
Learned Assistant Government Pleader for Revenue, relying on the written instructions dated 28.01.2016 received from the Tahsildar (FAC), Bathalapalli, informed this Court that there was a proposal to construct a High Level Bridge across Chitravathi river from KM 112/0 to 115/0 on National Highway-42 in Ananthapuram District, and that steps were being taken. He further stated that a notification had already been published under the provisions of the National Highway Act, 1956, and that the due procedure laid down by law would be adhered to while taking over the required lands.
In the light of the aforestated stand of the revenue authorities, which is duly taken on record, no adjudication is warranted in this writ petition which is closed permitting the respondent authorities to follow the due procedure laid down by law in the context of the petitioners' lands.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
